New Code Will Improve Use Of Footpaths

The South Gippsland Shire Council’s new ‘Footpath Trading Code’, developed through community consultation to improve the use and access of our footpaths, came into effect on 1st August.

"Footpath dining and sidewalk sales can add a delightful ambience to a business or entertainment area and contribute directly to the economic and social vibrancy of a town, but we need to ensure that we are not limiting access or creating hazards for pedestrians" commented South Gippsland’s RuralAccess Project Coordinator, Ms Kathryn Pryor.

Council manages footpaths and when appropriate, permits businesses to use the footpath. It will generally support, and provide a permit for items on the footpath if they do not pose a pedestrian/traffic safety hazard, do not have a negative impact on the amenity of the street, and do not significantly impair pedestrian movement and access.

Businesses do not have a guaranteed right to use the footpath for trading purposes.

Local trader David Panther of Panther’s Mensland, Leongatha has embraced the new Code that combines safety and good business principles.

"I have had some special stands built that allow me to market my goods in an attractive and safe fashion, and not hinder the progress of pedestrians, "said Mr Panther. "The customer response has been excellent and my products are well protected from the weather."

"A permit may be required to place items on or above the footpath, either on a permanent or temporary basis. Whilst most applications will require a Local Law permit only, some may require a permit under different regulations. It’s always best to check with Council before placing any items on the footpath," said Local Laws Officer Graeme Peters.

As part of the implementation process, Council is currently undertaking an audit of the placement of its street furniture on footpaths across the shire. Following the audit, Council will develop a plan to ensure any inappropriately placed street furniture is removed or relocated in order to comply with the Code.
