Council Moves On Proposed Heritage Controls

The Bass Coast Shire Council last night made a decision on how to move forward with the Shire’s proposed Heritage Overlay. The decision involves splitting the proposal into three parts.

The Council recommended around 180 properties be dropped from the current draft. This includes 22 individually listed properties, the abandonment of the Cowes Residential and South Dudley Precincts and a reduction in the boundaries of other Precincts.

However, some properties, such as those in the deleted South Dudley Precinct, will be reassessed by Council to see if they warrant individual heritage listing. In these cases the precinct will go to an Independent Panel to be convened by the Minister for Planning.

The Council also recommended that the individually listed properties it received no objections about be sent to the Minister for Planning for final approval. This would mean the heritage controls would apply on these properties permanently.

The remaining properties and precincts, which had issues that could not be resolved, will also be sent to the Independent Panel.

Property owners may state their case in person at the Panel, which will be held in the coming months. Property owners will be advised in writing by Planning Panels Victoria when this will take place.

The Council’s decision was consistent with the recommendations of the Review Committee, formed to look at the submissions made by property owners regarding the Heritage Overlay. The Review Committee consisted of representatives from Council, Heritage Victoria, the Department of Sustainability and Environment and local historical societies.

Council’s Planning and Environment Director, Andrew Mason said the Review Committee and Council did the best it could to resolve individual issues with the information it had.

"There may still be some issues that property owners wish to raise, which is why an Independent Panel is necessary.

"If you haven’t made a submission, but wish to speak with the Independent Panel, please contact our Strategic Planning Team," he appealed.

Mr Mason said the Overlay was a complex and controversial matter.

"We wish to assure the community that the process we are going through now will ensure everyone is able to have their say."

Mr Mason said there were many sound reasons for having a Heritage Overlay.

"We are required by State Government to protect the heritage of our towns, whatever form that may take.

"There has also been a lot of community concern about the loss of character of our towns and inappropriate development and this is one important way to help us control this," Mr Mason finished.
