New regulations to be introduced for owner-builders

Free owner-builder seminars are being held in Gippsland at the Warragul Civic Centre on Thursday 26 May and at the Wellington Entertainment Centre, Sale on Monday 30 May, to explain new regulations being introduced for owner-builders.

From June 2005 owner-builders carrying out domestic building work valued at over $12,000 will be required to obtain a Certificate of Consent before applying for a building permit.

Latrobe City’s Building Surveyor, Rob Dunlop said that the regulations had been brought in to provide greater protection for consumers buying owner-built properties.

"The new rules will also safeguard and provide information to genuine owner-builders as well as bringing Victoria into alignment with the other states across Australia," Mr Dunlop said.

"An owner-builder is defined as a person who constructs or renovates a domestic building on his or her own land, who is not in the business of building. From June 2005, these persons will now have to obtain a Certificate of Consent from the Building Practitioners Board in order to obtain a building permit to carry out domestic building work valued at $12,000 or more.

"They must also read and understand information on their legal obligations and responsibilities.

"The Certificate of Consent provides the owner-builder with the opportunity to obtain building permits for a single dwelling and associated work on a single property, in any three-year period," Mr Dunlop explained.

To apply for a Certificate of Consent, owner-builders need to apply for an Owner-Builder Information and Education Kit available from the Building Commission on 1300 360 320.

"Other requirements in the process include providing details of other building permits for domestic work carried out in the previous three years; confirming current residency and intention to reside in the dwelling; providing a description of the proposed project and existing buildings on the land," Mr Dunlop added.

"Without the Certificate of Consent, an owner-builder cannot apply for a building permit from their local authority or registered building surveyor. It is vital that owner-builders understand their obligations when proposed constructions are valued at more than $12,000," Mr Dunlop concluded.
