Bass coast proactive with local laws

Bass Coast Shire Council has produced a new local law to assist in maintaining a safe, pleasing, peaceful and healthy environment for the whole community.

General Local Law of 2005 No.1 of 2005 was made by Bass Coast Shire Council on 21 September 2005 and replaces previous local laws 1, 8 and 9.

Why do we have local laws?

"Local laws are designed to curb anti-social and annoying behaviour within the community," said Council’s Community Safety Manager, Peter Laydon.

"They assist in the removal of nuisances and dangers, while encouraging people to consider both those around them and protection of the environment.

Mr Laydon explained that well-developed local laws allow Council to act in the best interests of the greater community. For Bass Coast Shire Council, the focus of Local Law is on education, rather than infringement.

"Council see these laws as pro-active law enforcement," said Mr Laydon.

"Its about educating people about what is acceptable behaviour, and hopefully stopping them doing the wrong thing.

Revision of local laws

The revision of local laws has come about for a number of reasons. In line with the requirements of the Local Government Act 1989, the local laws have a Sunset provision of ten years.

"Council was also eager to adopt a best practice model, which would respond to concerns gathered from community consultation and place Bass Coast Shire in line with other councils," stated Mr Laydon.

To achieve this, a number of existing Local Laws and Policies were repealed and replaced by a single document. Mr Laydon said that the aim was to streamline the process and interpretation of local laws and provide a simple, easy to understand document for the whole community.

A number of areas that were identified as weaknesses in the previous local laws have been addressed. These areas include:

  • Keeping of Animals
  • Litter on Building Sites
  • Keeping Properties Tidy
  • Camping in Public Places
  • Consumption of Alcoholic Beverages
  • Care of Livestock

General Local Law of 2005 No. 1 of 2005 will enable Council to address issues in a proactive way with a focus based on prevention rather than cure.

A copy of the Local Law is available for inspection at Council’s Customer Service Centres and is available for download from Council’s website at www.basscoast.vic.gov.au.
