No Trade Without A Permit

Bass Coast Shire Council will be strictly enforcing permit conditions relating to footpath trading.

Council’s Community Safety Manager, Peter Laydon said a renewed focus on trading permits in light of the recent decision regarding footpath trading in Cowes was just one of the reasons behind the move.

"We are also responding to criticism that Council was not applying a stringent approach to breaches of permit conditions," said Mr Laydon.

"In addition, the cost to Council to chase up traders who fail to renew their permits has become prohibitive."

In February this year, Council made a decision not to renew permits for footpath trading in designated areas of Cowes. This decision means that all footpath merchandising displays in that area have been removed. Al fresco dining in the area was not affected by the decision.

Other traders across the Shire who require permits for footpath trading, al fresco dining and the use of A frame signs had until the close of business yesterday to renew their permits.

Council’s Community Safety Manager, Peter Laydon said that renewal notices were sent out to businesses two weeks ago.

"As per our normal practice, the renewals went out with a letter, which outlined the conditions of the permit," said Mr Laydon.

"The letter also clearly stated that traders needed to renew by 31 May or their permit would expire.

"There has been a high level of cooperation from the traders in the designated area in Cowes who have been affected by the decision to ban merchandise displays on the footpath," continue Mr Laydon.

"But there are a large number of traders across the Shire who failed to renew their permits.

"In the past, we have taken a lenient approach to this, but it has resulted in Council staff often having to chase up permit payments for many months."

Mr Laydon stressed that without a valid permit, traders would not be permitted to have displays, al fresco dining or A frame signs outside their premises.

"Our Local Laws officers will be contacting all traders who have yet to renew their permit and letting them know they need to renew them today," said Mr Laydon.

"Unless these permits are renewed, the traders will not be allowed to operate footpath activities tomorrow."

Mr Laydon confirmed that any trader operating without a permit will receive a notice to comply and faced the risk of a fine of $200 fine being issued.

"The notice to comply gives the business a reasonable amount of time to remove displays, signs or chairs and tables from the footpath," said Mr Laydon.

"Anyone who fails to remove the items will receive a second notice from Council and risks having their goods impounded and their permit revoked.

Mr Laydon urged any traders who had not already renewed their permit to contact Bass Coast Shire Council’s Local Laws team immediately.
