Submissions In On Proposed Heritage Controls

Bass Coast Shire Council has received over 190 submissions in relation to the proposed heritage overlays.

The proposed controls relate to 166 individual properties and six precincts, five in Wonthaggi and one in Cowes, including 700 properties.

The properties currently have temporary heritage controls in place, brought in by the Minister for Planning in September 2006.

Submissions on the proposed controls have been received since December 2006 and closed on March 5.

Council’s Planning and Environment Director, Andrew Mason said many of the submissions were from people objecting to the overlay over their property.

"There are also some supportive of the controls over their property.

"The written submissions will now be considered by a Review Committee," Mr Mason advised.

The Review Committee will include an independent Chairperson, five Councillors, representatives from Heritage Victoria, the Department of Sustainability and Environment and from each of the local historical societies, and Council’s Chief Executive Officer, Director of Planning and Environment and Strategic Planning Coordinator.

Mr Mason said the Committee would have an advisory role and would not be a decision making body.

"The Committee will make recommendations regarding each property."

In regards to the submissions objecting to the controls, the Committee will determine the following:

a) The property or precinct may have heritage value, but there are issues that cannot be solved by the Review Committee.

Outcome – Recommend that Council refer the submission to an Independent Panel, set by the Minister for Planning.

b) The property or precinct may have heritage value, however, there are some minor errors in the listing or updates required.

Outcome – Recommend that Council refer the submission to an Independent Panel with recommended changes.

c) The property or precinct is considered to have no heritage value or there are material or substantial mistakes in relation to the listing.

Outcome – Recommend that Council abandon the Heritage Overlay over this property or precinct.

"This information will be provided to the Council in a report at the Council Meeting on April 18. The Council will then decide how to move forward," continued Mr Mason.

He also stressed that a Heritage Overlay was simply an additional control to help prevent inappropriate development and protect neighbourhood character.

"Over a number of years we have received community feedback that people are concerned about inappropriate development and a loss of character in their area," said Mr Mason.

"The use of heritage controls is not unique to Bass Coast. They are used in many municipalities throughout Victoria.

"There are currently nine other Overlays in the Bass Coast Planning Scheme including ones to protect significant landscapes, vegetation and to control building height."

Mr Mason added that not all buildings in the Shire were included in the proposed Overlay and that all affected property owners have been notified.
