Vista Place - VCAT Upholds Council Decision

The Victorian Civil and Administrative Tribunal (VCAT) upheld Council’s decision to refuse a permit for a development at 12-18 Vista Place, Cape Woolamai.

The VCAT ruling stated the proposal for a two storey building including a tavern, shops and backpackers was an overdevelopment of the site.

Council’s Planning and Environment Director, Hannah Duncan-Jones, said the decision was welcomed by Council.

"Overdevelopment of the site was a key component in Council’s decision not to support the proposal at the meeting on 16 August 2006," said Ms Duncan-Jones.

"There were also concerns about the impact it would have on the area and the lack of suitable car parking. Council certainly felt the proposal was out of character with the Cape Woolamai area."

Ms Duncan-Jones said that although the Council’s decision had been upheld, the Tribunal had found that the site was suitable for more than one use.

"The VCAT report said that a 120 person licensed tavern with a TAB facility, separate backpacker’s accommodation, and shops, were were an over development of the site," said Ms Duncan-Jones.

"However, the report clearly stated that some development incorporating perhaps two rather than the three proposed uses could be considered.

"At this stage, Council has not received an amended proposal from the developer."
