Call To See Draft Disability Legislation

The Nationals have again called for the State Government to publish a draft of any new disability legislation, so that disability advocacy groups and the general public can see for themselves what is proposed.

Gippsland MP Peter Hall, who wrote to the Minister two months ago seeking some indication of proposed legislation, is concerned that the outcome of the Government’s review of disability legislation is imminent and could be pushed through Parliament.

He is also worried that the changes could draw attention away from critical issues, such as accommodation.

Mr Hall said disability advocacy groups were very concerned that services may be eroded under new legislation.

"They want to see what is actually proposed. Already this year we have seen the Bracks’ Government slash funding to school students with disabilities and I have grave fears that similar cuts are about to be applied more broadly across the disability sector," Mr Hall said.

The review of the Intellectually Disabled Persons’ Services Act and the Disability Services Act has been underway since 2003 and involved a state-wide consultation process. Recommendations were published late last year, which, if adopted, will bring about major changes in the way disability services are provided.

Mr Hall said the Government should now make its final views public by way of an exposure draft of new legislation so all Victorians could consider it before it is put through Parliament.

"The fact is that the new legislation may not take into consideration any of the consultation process and result in a worse situation for people with disabilities," Mr Hall said. "How would we know, unless there is a chance for advocacy groups and others with an interest in this area are able to look at the actual proposals and make considered responses to that?

"While the new legislation has been some time in coming, it is worth taking the extra step to get it right. For once I hope the Government lives up to its claim of being honest, open and accountable by publishing its proposals and allowing all Victorians a chance to comment."

Mr Hall said he was also concerned that the Government would use new legislation to take the focus from critically urgent needs in the disability sector. The most urgent of these is accommodation.

"The Minister conceded in December last year that more than 3,000 disabled people were on the urgent waiting list for accommodation. Many of these have been cared for throughout their lives by parents who are now aged and fear for their son or daughter’s future."

Mr Hall said there was also extensive waiting lists for in-home support and day programs. He added the severe shortage of respite options also impacted harshly on those with disabilities and their families.

"The needs of those with disabilities has never been greater and the Government would be better served by addressing their needs, rather than by creating bureaucratic change that delivers little, if anything, to those in need," he said.
