Council Investigating Newlands

East Gippsland Shire Council will consider the possibility of amending the East Gippsland Planning Scheme to re-introduce site specific controls in Colony Club Drive, Newlands Arm.

A number of Colony Club Drive residents have expressed concern to Council in relation to development of land on the northern side of the road.

Initially, development of land on the north side of Colony Club Drive was not allowed as part of the estate. Prior to Council amalgamations, the Shire of Bairnsdale Planning Scheme allowed for the subdivision and development of the land without the need for permits, provided everything was consistent with concept plans incorporated into the Scheme.

A total of 25 lots have been created on the north side of Colony Club Drive. Nine houses have already been constructed and approvals exist for a further six sites.

A key component of the concept plan was three-dimensional building envelopes that provide property setbacks and height controls. These controls were designed to minimise the impact of development on properties to the rear, the use of the adjoining public foreshore and the appearance of buildings from the Lakes.

A planning permit was required to develop in a way that was outside the scope of the concept plan.

The controls contained in the Bairnsdale Shire Scheme were not subsequently translated into the East Gippsland Planning Scheme, as all development in Newlands Arm requires that a planning permit first be issued.

A Position Statement adopted by Council in December 2001, reads "Council supports the development of housing that is of a standard and appearance which is appropriate to the context, location and setting of Newlands Arm".

The statement also said Council will ensure each application received for a dwelling are referred to Council, giving particular consideration to the new decision guidelines and planning scheme controls outlined in the East Gippsland Planning Scheme.

"Residents of Newlands Arm have expressed their concern about the standard of residential development that has been approved," Shire Group Manager Development Services, Kate Nelson said.

"There are existing processes to allow input for those residents affected by applications, however in line with a request from community members, Council will investigate the possible amendment to the Planning Scheme, with particular emphasis on height controls, for land on the lake side of Colony Club Drive," Kate said.
