Liquor Licence Premises Must Prepare For New Smoking Laws

Latrobe City is urging all liquor licence holders in the municipality to check their compliance with the new requirements under the Tobacco Act that will be implemented on 1 July 2007.

Acting Chief Executive Officer, Philip Marsh said that these changes will have an impact on premises with liquor licences as smoking will be banned in enclosed licensed areas and some outdoor dining areas.

"From 1 July 2007, patrons at licensed premises will no longer be allowed to smoke inside or in an outdoor dining area that has a roof and walls covering 75% of the notional wall area.

"In effect, licensed premises will have to provide an outdoor dining and drinking area that complies with the Tobacco Act 1987. Change of use of a building will require the correct permit through council.

"If provision of such an area is not possible, and patrons smoke on the footpath or outside the premises, the licensed premises must ensure that other local laws such as littering, noise or street obstructions are not contravened," Mr Marsh explained.

"To assist with preparing a premises for these changes, Latrobe City Council’s planning department can advise on planning permits or letters of consent for any establishment.

"Council has found that whilst generally larger hotels and restaurants have already made the necessary changes, many of the smaller businesses and clubs are not covered by their current liquor licence. It is these organisations that must apply for a new planning permit or get a letter of consent from council," Mr Marsh added.

"We would encourage all businesses that might be affected by these changes to make the necessary applications or to contact council for advice. By organising consents through council, businesses and organisations reduce the risk of non-compliance with Liquor Licensing Victoria," Mr Marsh concluded.
