Bass Coast Council Takes Cases To CourtThe Magistrate found 14 charges brought by Bass Coast Shire Council proved By Bass Coast Shire Council - 16th April 2002 - Back to News On Friday, 12 April 2002 the Wonthaggi Magistrates Court dealt with a total of 19 charges brought by Bass Coast Shire Council.
A further 15 charges laid against Mr Frank Mangione for alleged illegal trading by operating a mobile ‘Mr Whippy’ ice cream van were adjourned to 17 May 2002.
The Magistrate found 14 charges brought by Bass Coast Shire Council proved.
Six defendants were found guilty of drinking alcohol in a public place. All 6 had their original fine of $100 increased to $400 and were ordered to pay a further $175 in costs to the Council.
Three defendants were found guilty of camping on public land without a permit. All 3 had their original fine of $200 increased to $500 and were ordered to pay a further $175 in costs to the Council.
A Cape Woolamai resident was found guilty on three charges of having a nuisance dog. Charges were laid by Council as a result of repeated complaints by neighbours about his barking dog. He was fined a total of $300 and ordered to pay a further $300 in costs to the Council.
One person was found guilty of riding a skateboard, and another of rollerblading, in a prohibited and signposted area of Wonthaggi. The Magistrate imposed the maximum fine of $200 in each case and ordered each defendant to pay a further $175 in costs to the Council.
A further 4 charges were withdrawn as a result of the defendant paying the original penalty, plus additional administrative costs, prior to the hearing.
One charge of camping on public land without a permit was dismissed.
Bass Coast Shire Council’s Local Laws Team Leader Officer, Kaye Hall, said that she was pleased with the successful outcome of the majority of the hearings. "Council’s Local Laws Officers, together with officers of the Victoria Police, worked diligently and consistently over the summer period enforcing our local laws," she said.
Bass Coast Shire Mayor, Cr John Gains said: "Residents and visitors can be assured that Council implements its local laws fairly but firmly."
"Unfortunately there are some people in our community who don’t want to obey the law. Council recognises that the rest of the community expects Council to take further action through the courts under these circumstances and that a clear message needs to be sent to these few," he added.
