New Building Regulations In Force

New and improved Building Regulations now apply with particular changes for building surveyors, drafts persons, architects and owners of shared accommodation premises.

The new regulations have been introduced by the State Government and Building Commission.

Bass Coast Shire Council’s Building Services Manager, Stephen Rosendale, says the aim of the changes is to make the regulations easier to use, read and apply.

"Regulations are only interim while the State Government completes a full set of new Regulations to replace the Building Regulations 1994."

"However, the new regulations do contain important changes, which everyone involved in the building industry should be aware of," Mr Rosendale said.

Key features of the new regulations include:

  • All building sites must display a sign that clearly shows registration numbers and contact details of the builder and building surveyor, and the building permit number and issue date.
  • Smoke alarms must be fitted in all class 1b, 3 and 9a shared accommodation facilities and sprinklers in all class 3 shared accommodation.
  • Building permit exemptions will be now be based on the scope of building work rather than the previous $5000 limit, which implies the need for most garages and carports to have a permit.

The new regulations also mean that owner/builders must:

  • Obtain a Certificate of Consent from the Building Practitioners Board for all domestic building work over $12 000.
  • Only obtain building permits for a single home and associated work on a single property in any three-year period.
  • Reside and continue to reside, or intend to reside in the home being built.

To obtain a Certificate of Consent, owner/builders must get hold of an Owner/Builder Information and Education Kit and send the enclosed statutory declaration and application form and $75 fee to the Building Practitioners Board.
