Linfox VCAT Hearing Moved To 2008Phillip Island will have to wait until 2008 to find out if the proposed Linfox Property Group resort development will go ahead. By Bass Coast Shire Council - 2nd November 2007 - Back to News The Victorian Civil and Administrative Tribunal (VCAT) granted Linfox’s request for an adjournment at a hearing held last week.
Council’s Planning and Environment Director, Hannah Duncan-Jones, said the adjournment wasn’t unexpected.
"All applicants to VCAT are allowed to request an adjournment to allow them time to put together their case," explained Ms Duncan-Jones.
"If that request is made, VCAT normally do grant an adjournment."
Ms Duncan-Jones confirmed that the new dates for the hearing would start from 3 March 2008 and run for three weeks.
"There were a number of other conditions set by VCAT in relation to the new hearing date," said Ms Duncan-Jones.
"Linfox has to circulate any expert evidence they will be presenting at the hearing by 14 December this year.
"Council and any other parties to the appeal have until 4 February 2008 to circulate evidence they plan to present," continued Ms Duncan-Jones.
"A site inspection date was also tentatively listed for 28 February 2008."
VCAT also ruled that the cost of the adjournment had an impact on the Phillip Island Conservation Society. As a not-for-profit organisation, the Conservation Society is represented by the Environment Defenders Office (EDO). Linfox were directed by the Tribunal to pay the EDO costs of $750 for attending the adjournment hearing.
