New Laws For Owner Builders

New owner-builder laws will soon be introduced in Victoria to provide greater protection for consumers, genuine owner-builders and registered building practitioners.

East Gippsland Shire Council’s Municipal Building Surveyor Leigh Collings said that from 14 June 2005 owner-builders must obtain a Certificate of Consent from the Building Practitioners Board in order to obtain a building permit to carry out domestic building work valued over $12,000

"Also, they may only obtain building permits for one single dwelling on a property in any three-year period," he said.

"Owner-builders carrying out additions or alterations to their dwelling will also need to obtain a certificate of consent, but these are not limited."

Mr Collings said that other changes require that owner builders must reside and continue to reside, or intend to reside in the single dwelling.

"In order to obtain a Certificate of Consent, owner-builder must also read and complete the Owner-builder information and Education Kit, sign the statutory declaration and complete the application form that is now available from the Building Practitioners Board or request the kit on-line at the Building Commission web site.

"They must also send the statutory declaration, application form, an application fee of $75 and any supporting documentation to the Building Practitioners Board," he said.
