Council Acts on Criterion Hotel

Wellington Shire Council has instigated legal proceedings against the owner of the Criterion Hotel. The proceedings relate to demolition works being undertaken at the hotel without appropriate permits.

"It is disappointing that Council has been forced to take this action, but the hotel has been left in an unsafe condition because of these works," said Cr Malcolm Hole, Mayor of Wellington Shire Council.

"We had hoped the Hotel owner would repair and improve this very historic building.

"Regrettably offers of financial support to assist in a restoration of the building have not been taken up by the owner. Discussions between the owner and the Building Commission and Heritage Victoria have not been fruitful.

"Instead the building is now in a sorry state and poses a public danger," said Cr Hole.

The historic hotel was built in 1865 and the distinctive verandah added in 1878. The building is a landmark in Sale, and listed on the historic buildings register.

"The recent history of the building is very sad indeed," said Cr Hole.

"Council does not have the power to force anyone to restore a historic building.

"But we are empowered to prosecute for illegal building works, including illegal demolition," said Cr Hole.

Wellington Shire Council has issued charges against the owner of the hotel. The case is listed for mention at the Sale Magistrates Court on 8 August 2006.

The charges relate to the removal of internal walls and a bar at the hotel without the required permits.

In separate action under the Building Act 1993, the Council has also enforced a requirement for protective scaffolding to be installed under the hotel’s verandah to improve safety for pedestrians. An order is also in place for the building to be vacated and secured to protect occupants and patrons.
