A Holden commodore car and an array of diving equipment were also forfeited.

The man was also placed on an order that prevents him from being in possession of abalone or commercial fishing equipment within 10 kilometres of Victorian marine waters for a period of five years.

Magistrate Louis Hill heard that Fisheries Officers had detected the defendant diving for abalone at Cape Conran on January 19 this year. The man was found to have in his possession 116 abalone, of which 28 were under the legal size limit of 12 cm.

The catch limit for abalone is five per day.

Prosecutor for Fisheries Victoria David Bull said: "The East Gippsland coastline is subject to regular patrols at varying hours of the day and night in order to protect the abalone fishery which is worth about $70 million dollars annually to the Victorian economy."

Members of the public who wish to report illegal or suspicious fishing activity are encouraged to ring 13FISH (Ph. 13 3474) 24 hours a day, seven days a week.
