From 7 to 10 October 2014, an independent Planing Panel considered submissions to Amendment C82 which seeks to apply the Land Subject to Indundation Overlay (LSIO) across areas in the municipality that have been identified as being at risk of inundation.

"At the hearing, Council presented a joint submission with Melbourne Water and the West Gippsland Catchment Management Authority," Council’s Acting General Manager Sustainable Development and Growth, Jodi Kennedy, said.

"A further 17 parties made presentations, including one party that represented East Cowes/Silverleaves C82 Action Group.

The Panel considered all submissions and presentations made to it and concluded that the methodology, datasets and process undertaken by the proponets – Council, Melbourne Water and West Gippsland CMA – were appropriate."

Ms Kennedy said the Panel concluded that the LSIO should allow for the potential impacts of climate change, specifically by planning for the effects of 0.2 sea level rise to 2040 in urban areas within town boundaries and 0.8m sea level rise by 2100 in all other areas, consistent with State policy,

"The report recommends that Council adopt the amendment as exhibited with some changes," Ms Kennedy said.
