rhyll development rejected
Bass Coast Shire Councillors were definite in their rejection of a proposed hotel development in Rhyll.
At the Council Meeting on 15 August, a recommendation not to support the application for a hotel retreat in Rhyll was carried unanimously.
The applicants, SCK Investments, had already lodged the proposal with the Victorian Civil and Administrative Tribunal (VCAT).
This is because Council did not deliver its decision within the 60 day period set for planning permit applications.
Council’s Acting Director of Planning and Environment, Hannah Duncan-Jones confirmed that Council did not meet the 60 day deadline.
"This was a very large proposal and we received 477 submissions opposing the development," explained Ms Duncan Jones.
"It simply wasn’t possible for our staff to thoroughly assess the proposal within that time frame.
"This is not unusual in the case of a large proposal, although we usually manage to negotiate with the developer for an extension," continued Ms Duncan-Jones.
"In this case, it is likely the developer didn’t feel Council would support the proposal, so they’ve gone direct to VCAT."
Ms Duncan-Jones said the decision at the Council meeting provided a clear direction for planning staff who would be attending the VCAT hearings.
"Our staff will not be supporting this application at VCAT. The recommendation from the Council Meeting very clearly sets out the basis on which we will argue against the proposal," said Ms Duncan-Jones.
"The proposal isn’t supported because it fails to properly address a number of our policies and guidelines and is out of character for the neighbourhood.
"It certainly would have a drastic effect on the existing village feel of Rhyll."
The VCAT hearing is scheduled for 8 October 2007 at 10am at 55 King Street, Melbourne. However, it is understood that the developer has applied to VCAT for an adjournment as their legal representative is not available on that date.
