Minister Says No To Municipal Review

The Minister for Local Government, Candy Broad MLC has written to Bass Coast Shire Council, advising that the State Government will not be conducting a Municipal Review.

Council received the letter, dated 15 May 2006, clearly outlining the reasons behind the decision.

"In relation to the Council’s request of a review of the Shire boundaries, I have previously stated that I believe that local government has undergone significant structural reform in recent years and further changes are therefore not generally desirable, unless there are truly exceptional circumstances. I am not aware of any exceptional circumstances that have been identified which would justify consideration of de-amalgamation or a change to the Bass Coast Shire Council’s boundaries."

"If the Council wishes to engage an independent body or person to conduct a review of its operations it has the power to do so. It is not appropriate for the State Government to conduct a review of a Council’s operations and/or performance in the absence of any evidence that the Council has not met its obligations under the legislation. There is no evidence to suggest the democratically elected Council is not operating within its responsibilities under the Local Government Act 1989."

The Minister went on to state that "…neither my Department nor I have cause to intervene in the administration of the Bass Coast Shire Council."

Bass Coast Mayor, Cr Neville Goodwin said the response from the Minister was very clear.

"Council will be meeting to discuss the response," said Cr Goodwin.

"From there we will decide what further action will be taken in regard to this matter."

Cr Goodwin said that while some members of the community would be disappointed with the Minister’s reponse, the Minister’s statement that there was no cause to intervene in Council’s administration, was a very positive message.

"The Minister’s letter emphatically refutes recent speculation in the local media, "said Cr Goodwin.

"This letter shows there is absolutely no truth in the claims that the Local Government Minister is about to intervene and sack the Council.

Cr Goodwin confirmed that the scheduled meeting between Bass Coast and Minister Broad would still take place on 6 June 2006, where Council will discuss the Minister’s decision and other issues considered part of the review.

Background:

At the Ordinary Meeting on 15 February 2006, Council unanimously supported the following motion:

"That the Bass Coast Shire Council requests the State Government to conduct an independent review of the Council’s operations, performance, structure, policies and procedures – to include a review of the Shire boundaries".

A letter was forwarded to the Local Government Minister on 31 March 2006 in relation to the resolution and requested a meeting with the Minister to discuss the terms of the review.
