Magistrates ProceedingsFlamin Donuts and Not Maccas in the Latrobe Valley Magistrates proceedings this week. By Portal Admin - 2nd April 2019 - Back to News Latrobe City Council successfully prosecuted the operators of Flamin Donuts and Not Maccas in the Latrobe Valley Magistrates Court this week.
The court ordered the operators of Flamin Donuts and Not Maccas to pay fines and costs totalling just over $10,000 for operating without relevant planning permit approval. Since November 2016 Council Planning Officers tried to work closely with the operators of Flamin Donuts and Not Maccas to try and bring their operations at Lloyd Street, Moe into compliance with the Latrobe Planning Scheme. Concerns were raised about the contamination of the land due to its previous use as a service station. The operators of Flamin Donuts and Not Maccas were not willing to carry out a site assessment resulting in Council being unable to continue their assessment of their planning application.
Latrobe City Council will now lodge an enforcement order with the Victorian Civil and Administrative Tribunal (VCAT) seeking to remove all illegal development off the land.

Latrobe City Council Mayor Graeme Middlemiss said "Where land owners and business owners are working with us to address any non-compliance issues, we will work co-operatively to ensure all regulatory approvals are in place to ensure there is no negative impact on our community. However, if operators continue to operate illegally without all required regulatory approvals, especially where there are possible contamination issues that could impact the health of members of our community, then we will not hesitate to exercise all the legal avenues available to use"
